OEM vs ODM supplements: choose your development path
Choose OEM or ODM for a US supplement project by formula readiness, development deliverables, ownership, samples and the scope of the quotation.

Choose by the work your project still needs
Start with OEM if you have a controlled formula and product specification that you are authorized to use, and need a production proposal. Start with ODM if ingredient selection, serving concept, format or other development choices remain open. A project can combine development work with later production of the accepted specification. Supplier definitions differ: the written deliverables determine the scope. Private label describes the branding arrangement; it does not tell you whether the formula is ready.
Compare the two paths
- Formula: OEM starts with your specification; ODM starts with a concept and a defined development brief.
- Samples: OEM evaluates the proposed implementation; ODM may need alternatives before selecting a specification.
- Changes: OEM needs rules for permitted substitutions; ODM needs rules for selecting and revising candidates.
- Ownership: both paths need written terms for formula use, development outputs, artwork and any exclusivity.
- Commercial scope: both need the same clarity on MOQ, testing, packaging, delivery terms and release responsibilities.
Check what you can actually hand over
- Existing capsule formula: provide its revision, ingredient identities and amounts, raw-material requirements, shell, pack and acceptance criteria. Identify any information still missing before requesting OEM pricing.
- New gummy concept: provide the intended US audience and channel, ingredient direction, proposed serving concept, flavor, texture and exclusions. Ask for a priced ODM feasibility and sample scope.
- Reference product only: identify the characteristics you want to assess and the rights you hold. A retail label or photograph is not a complete transferable formula.
- Partly developed product: list fixed decisions separately from work still needed. Ask for development and production to be quoted as separate stages.
Agree ownership and permitted use before development
Record who supplies the starting formula, who may use the development outputs and what documents you receive after payment. Address ingredient substitutions, artwork, tooling, confidentiality and any exclusivity separately. Ask whether you can transfer the accepted specification to another manufacturer and which information can be shared for that purpose. Neither the OEM nor ODM label grants ownership or exclusivity by itself; these are matters for the actual agreement.
Compare cost and timing using the same scope
Separate feasibility, formulation work, sample rounds, testing, artwork and tooling from the recurring production price. Compare the same formula revision, pack count and delivery point. Request a timeline for each stage with its start conditions, including the information, approvals and materials needed. Do not assume OEM is always cheaper or ODM is always slower: unresolved specifications, revisions and packaging can change either proposal. Obtain written prices and dates for your project.
Use a decision gate for each deliverable
- Feasibility: receive the accepted requirements, open questions, proposed manufacturing scope and assumptions behind the quotation.
- Samples: identify each formula and pack revision, the assessment purpose, permitted changes and the included revision rounds.
- Production handover: reconcile the accepted sample with the formula, packaging, test plan and signed commercial scope.
- Batch release: review the agreed batch-specific documents and record the authorized release decision before shipment. Sample approval is a separate decision.
Keep quality responsibilities in both routes
Agree who prepares specifications, approves changes, reviews labels, commissions testing and authorizes batch release. For US dietary supplements, 21 CFR 111.70 addresses component, product, packaging and labeling specifications; choosing an acronym does not replace those requirements. Identify the actual contracting and manufacturing parties. Assess the product version and intended use, and keep any unresolved regulatory or technical questions visible before committing to production.
Send the known details and the open decisions
Give NutraGuild your company, US sales channel, product concept or specification revision, preferred format, packaging, estimated quantity and target timing. State which decisions are fixed and which need development. NutraGuild coordinates formulation, samples, packaging and quotation discussions with an independent manufacturing partner; it does not own a factory. We use the brief to define the next discussion, with feasibility, costs, responsibilities and timing confirmed for the project.
